1 · Scope and contracting party

These terms govern the use of the MotoNavigator app and the associated services (together “the app”) between you and aditrix UG (haftungsbeschränkt), Hauptstr. 62, 97717 Sulzthal — full provider details in the imprint. How we handle personal data is set out in the privacy policy; it is information, not part of the contract.

2 · What the app is

MotoNavigator plans and guides motorcycle tours, records rides and provides maps for use without a network. It works without an account: the device identifies itself with a randomly generated identifier, not with your name.

The app is an aid to orientation. It replaces neither attention nor local knowledge nor compliance with the traffic rules.

3 · Formation, term, age

The contract of use is concluded when you install the app and start using it. It runs for an indefinite period and is free of charge for you. You can end it at any time by deleting the app — no notice of termination is needed, because there is no account.

The app is intended for people aged 18 and over.

4 · Paid features

Individual features can be subject to a charge (“Pro”); they are purchased as an in-app purchase through your device’s app store. The contracting party for the purchase is the operator of the respective store, not us; that operator’s terms govern payment, renewal, cancellation, withdrawal and refunds. From the purchase we learn only that an entitlement exists and for how long.

The entitlement is tied to the device identifier. If you reset the identifier, an active entitlement moves with it; beyond that there is no connection between purchase and person.

Paid features are at no time tied to your transmitting ride data. What costs money costs money — not data.

5 · Riding at your own responsibility

You ride at your own responsibility. You choose route, speed and riding style, not the app.

The app’s road data is based on OpenStreetMap. Whether a way may be ridden is often not recorded there at all, not up to date or not correct — especially for unpaved tracks, which some routing profiles deliberately include. A calculated route is therefore no statement that the route is permitted, passable or suitable for your vehicle.

Signage and the situation on the ground take precedence over any route. You judge closures, rights of way, surface, weather and your own condition on the spot. Operate the device only to the extent the applicable traffic rules permit.

6 · Maps, route data and software

The map data is based on OpenStreetMap; the app lists all sources and their licences under “About & Legal”. Rights granted to you by these licences remain unaffected.

For our software you receive a non-exclusive, non-transferable right to use it on your devices.

7 · Your recordings

Recorded rides stay on your device for as long as you have not agreed to their transmission. Consent is voluntary and can be withdrawn at any time; withdrawal ends future transmissions.

For recordings you have transmitted to us, you grant us the non-exclusive right, unlimited in time and territory, to store them, modify them, combine them with the recordings of others, and to use and exploit the results derived from them, including in relation to third parties and including after your use has ended. The purpose is to improve routing, map and place data, and the analysis of ride data in the app.

This grant of rights concerns the use of the data. Whether and for how long we may keep it in a form that can be linked to a person is governed by the privacy policy; your rights set out there remain unaffected.

8 · What is not permitted

  • automated mass retrieval from our services, or a level of use that significantly exceeds normal use
  • circumventing the checks that unlock paid features
  • reverse engineering our software; statutory permissions, in particular under §§ 69d, 69e UrhG, remain unaffected
  • interference with operations, for example through malware or overload

Sharing your own tours as a file does not fall under this — that is what the app is built for.

In the event of serious or repeated violations, we may block access to our services for the device identifier concerned.

9 · Availability and changes

We strive for trouble-free operation, but we do not owe any particular level of availability; maintenance, disruptions and changes to the services are possible. Navigation and recording deliberately work without a network connection too.

We may develop the app further and change features, as long as the purpose of the contract is preserved. We can change these terms if the legal situation, the range of features or technical processes require it. We show the amended version in the app. If you do not agree, stop using the app — which has no consequences, because there is no account.

10 · Liability

We are liable in accordance with the statutory provisions, with one limitation: in the case of slight negligence, we are liable only for the breach of a material contractual obligation — an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on which you may rely — and only for the foreseeable damage typical of this type of contract.

This limitation does not apply in the case of intent or gross negligence, not to injury to life, body or health, and not insofar as liability is mandatory by law.

Information about places, such as websites or phone numbers, comes from OpenStreetMap and therefore from third parties. We do not check it; it may be outdated or wrong, or lead to pages that have nothing to do with the place.

Nothing is transmitted to third parties until you open a link or dial a number. After that, their terms and privacy notices apply; we have no influence over third-party content. The same applies to the source and licence information in the app.

12 · Governing law and language

German law applies. Mandatory consumer protection provisions of the country of your habitual residence remain unaffected.

The German version is authoritative. Translations serve as an aid to understanding; in the event of discrepancies, the German text prevails.
